Acknowledgement

By using Humsafar, you acknowledge you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree, do not use the App and uninstall it.

Eligibility

The App is intended for users 18 years of age or older. By using the App, you confirm you are at least 18. We may terminate accounts we reasonably believe belong to a minor.

Relationship to Privacy Policy

Your use of the App is also governed by our Privacy Policy, which explains what data we collect, how we use it, and your rights. The Privacy Policy is incorporated into these Terms by reference.

Nature of the Service

Humsafar provides AI-generated companion personas for chat-based interaction. Companions are fictional characters generated by AI models, not real people, and conversations, images, and any expressions of affection are AI-generated content for entertainment purposes. The App is not a dating service, matchmaking service, mental health service, or a substitute for professional advice or genuine human relationships.

Acceptable Use

You agree not to use the App to generate, request, or share content that is illegal, involves minors in any way, promotes self-harm, harasses real individuals, or violates the rights of others. We may suspend or terminate accounts that violate this section without notice.

Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated responses may occasionally be inaccurate, repetitive, or in-character in ways that do not reflect factual advice — we do not warrant the accuracy or appropriateness of any companion's messages, and you should not rely on them for real-world decisions.

Subscriptions & Coins

The App offers subscription tiers (currently text-only and text+photos+calls tiers) billed through Razorpay, and, at higher tiers, a coin balance used to unlock images and call minutes. Manage or cancel subscriptions through the in-app billing flow. A lapsed subscription reverts your account to the lower tier (or free browsing) regardless of any remaining coin balance.

Refunds & Cancellations

You may cancel your subscription at any time from within the App; cancellation stops future billing but does not retroactively refund the current billing period, except as described below.

You are eligible for a full refund of a charge if you request it within 1 day of that charge and the App failed to function as described due to a verified fault on our end. To request a refund, contact us at anitax.labs@gmail.com with your payment reference. This refund is your sole and exclusive remedy for any App malfunction or service failure.

Limitation of Liability

To the maximum extent permitted by law, AnitaX Labs and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business, or emotional distress, arising from your use of or inability to use the App or reliance on any AI-generated content.

Our total aggregate liability for any claim arising from these Terms or the App shall not exceed the subscription fees you paid in the 3 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless AnitaX Labs, its team, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

Termination

We may suspend or terminate your access to the App, without liability, if we reasonably believe you have violated these Terms, misused the App, or engaged in fraudulent or abusive behavior. You may stop using the App and cancel your subscription at any time.

Force Majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including outages or changes by third-party platforms (Google Play, Firebase, Google Gemini, Fal.ai, Razorpay), internet or power outages, or government action.

Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts at Chhindwara, Madhya Pradesh, India.

Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and AnitaX Labs regarding the App and supersede any prior agreements or understandings.

Final Acknowledgement

By continuing to use Humsafar, you confirm your agreement to these Terms and Conditions and the Privacy Policy.
